We're going to need some better images; the ones you provided are barely silhouettes.
From the looks of it, and the size, I would say some it's sort of Camponotus queen and given the coloration you described, you may want to consider C. chromaiodes and C. herculeanus.

4. Length (from head to gaster):16 millimeters
5. Color, hue, pattern and texture: Black, dark red thorax, dark grey and black spots on abdomen no hairs
6. Distinguishing characteristics: 2 antenna segments 1 smallbump on back
7. Distinguishing behaveior
8. Nest description:

Or Camponotus novaeboracensis; But we need some much better images.
