A Formica? sp. This one has a different coloration compared to the other ones that I have found, which were just solid black.

 

Length: 4-5mm

Coloration: Abdomen: Black. Thorax: Black to light brown/light orange. Head: Black to light brown/slight orange. Antennae: Light Orange

Looks like Formica to me.
