3: Habitat: Hardwood forest
4: Length: 7mm
5: Color: Black and shiny
 
It has a smallish gaster, when I collected it I thought it was a Lasius parasite. After closer examination, I'm going to guess Crematogaster. (?)

You were correct on your first ID.

 

Crematogaster have bigger gasters and another petiole node / longer petiole node area.

Crematogaster will have pointy gasters as well, even the queens.

Thanks everyone. When I got home, i wandered the yard and noticed dead alates on my hottub cover. Maybe half dozen or so Crematogasters covered it. The must have flown earlier and baked on the hot cover. I checked around and found 2 wandering the patio! Dumped the umbratus. Grabbed another Myrmica and a few molestas. I can count confirm 7 species flew here these last 2 days.

Its a Lasius parasite spec. Your first guess was right.
